Overview
This bill clarifies the rights of juvenile defendants in New Jersey who choose to be tried as adults. It ensures these defendants receive the same procedural protections as adult defendants, including being treated as if their cases originated in the Criminal Part and subject to adult sentencing guidelines. The bill also establishes a presumption that juveniles will serve custodial sentences in juvenile facilities until age 21, with exceptions for safety concerns or when the juvenile is over 21. Finally, it allows for the case to be remanded back to the Family Part if it’s determined that the juvenile’s interests are better served there.
