Overview
This bill revises the law regarding agricultural trespass in New Jersey. It expands the definition of ‘lands’ susceptible to trespass to include more types of agricultural land, such as appurtenant woodlands and land used for storing agricultural equipment. The bill also removes the requirement of ‘knowledge’ or ‘recklessness’ as an element of the offense, making it easier to prosecute trespassers. Finally, it increases the potential civil penalties for violations.
