Overview
This bill establishes a rebuttable presumption of pretrial detention for defendants charged with aggravated assault of a law enforcement officer in New Jersey. If a prosecutor seeks pretrial detention, and the court finds that no conditions of release (bail, supervision, etc.) would reasonably ensure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will be in place. This presumption can be challenged by the defendant with a preponderance of the evidence. The bill also amends existing law to clarify the factors considered in determining pretrial detention and streamline the hearing process.
