Overview
This bill establishes a rebuttable presumption of pretrial detention for defendants charged with child sexual abuse or child endangerment in New Jersey. If a prosecutor seeks pretrial detention, and the court finds clear and convincing evidence that no conditions of release would reasonably ensure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will be in place. This presumption can be rebutted by the defendant or the prosecutor with sufficient evidence. The bill amends existing bail reform legislation to include these specific offenses.
