Overview
This bill increases the penalties for incarcerated individuals who possess items considered ‘implements of escape,’ such as weapons or tools, and for providing those items to inmates. Currently, possession of a weapon as an implement of escape is a second-degree crime with a minimum three-year sentence, while non-weapon items are a third-degree crime. The bill raises this to a second-degree crime with a minimum five-year sentence for all implements of escape. Additionally, the bill makes it a third-degree crime to provide any other contraband to an inmate that the provider knows is unlawful.
