Overview
This bill establishes a rebuttable presumption of pretrial detention for defendants charged with specific crimes that indicate a potential risk of flight. These crimes include obstructing the administration of law, resisting arrest, and escaping custody. If a prosecutor seeks pretrial detention, and the court finds clear and convincing evidence that no amount of bail, conditions, or a combination thereof would reasonably ensure the defendant’s appearance in court, protect public safety, or prevent obstruction of justice, a presumption of detention will be in place. This presumption can be rebutted by the defendant with a preponderance of the evidence.
