Overview
This bill establishes a rebuttable presumption of pretrial detention for individuals charged with carjacking, theft of motor vehicle, or burglary in New Jersey. If a prosecutor seeks pretrial detention and the court finds probable cause, a presumption will be in place that the defendant should be detained due to the risk of non-appearance, safety concerns, or obstruction of justice.
