Overview
This bill creates a new crime in New Jersey: domestic violence committed in the presence of a child. Specifically, it applies when the person committing the violence – such as a parent or guardian – knows a child is present and may witness the act. The severity of the crime depends on the underlying offense; it’s a fourth-degree crime if the underlying offense is minor, otherwise it’s one degree higher. Importantly, a conviction for this new crime won’t merge with any convictions for the underlying offense, and separate sentences will be imposed for each.
