Overview
This bill requires a drunk driver convicted of causing a parent or guardian’s death by reckless vehicular homicide to pay restitution on behalf of the deceased’s child. It establishes that the court must order restitution for the child’s financial support, considering the child’s and surviving parent’s needs, standard of living, and emotional needs. The restitution payments would continue until the child reaches 18 or graduates high school, or 21 if the child has a disability. The bill also addresses arrearages and offsets civil judgments with restitution payments.
