The Flood Zone Clarification Act modifies the process for determining flood hazard areas in New Jersey. Specifically, it requires the Department of Environmental Protection (DEP) to align State flood hazard delineations with those approved by the Federal Emergency Management Agency (FEMA) for the National Flood Insurance Program, limiting the elevation above the FEMA 100-year flood level to one foot. It also restricts the DEP’s ability to implement the recently proposed NJPACT rules, which would have adjusted flood elevations based on projected climate change impacts, until the legislature authorizes them.
