Overview
This bill allows victims of identity theft to petition a court for a determination of factual innocence. If a defendant was charged, arrested, or convicted using the victim’s identity, or if a criminal complaint was filed in their name, the victim can request a court review. If the court finds the victim did not commit the offense and that the identity association is a mistake, it will issue an order declaring the victim factually innocent and potentially sealing or deleting related information from court records. The Administrative Office of the Courts will also establish a database to track these cases and provide access to authorized parties.
