This bill changes the rules for filing postconviction petitions for a writ of habeas corpus in Nevada. Specifically, it clarifies which court a petitioner must file the petition with, depending on their location – either the district court in the county where they are incarcerated, the district court in the county where they reside if released, or the First Judicial District Court in Carson City if they are incarcerated outside the state or reside outside the state. The bill also addresses how petitions are handled if filed in the wrong court and clarifies that a petition cannot challenge both the validity of a conviction and the calculation of time served.
