Bill overview
This bill allows certain cities and counties within regions governed by interstate compacts, such as the Lake Tahoe region, to impose ‘linkage fees’ on developers. These fees are triggered when a regional plan calls for affordable housing development and identifies linkage fees and deed restrictions as tools. The fees can be applied to new residential units (over 1,000 square feet), additions to existing units (over 750 square feet), or significant remodels (over $100,000), with the funds used to support the development of affordable housing units meeting specific size and deed restriction requirements. The fees are subordinate to the powers of the regional planning agency and cannot be applied to development of affordable housing or accessory dwelling units subject to affordability restrictions.
