Bill overview
This bill changes the process for removing someone from a property due to forcible entry or detainer. Currently, property owners must serve a notice to surrender and go through a court process. This bill allows property owners, with the assistance of a sheriff, to submit a written complaint requesting removal if certain conditions are met, such as the property wasn't open to the public and the occupant isn't a tenant or family member. The bill also requires the Housing Division Administrator to create a form for local law enforcement agencies to use when entering properties for sale to address forcible entry. It establishes fees for sheriff services and revises the crime of forcible detainer, including penalties for false statements.
