This bill changes how witnesses can testify in preliminary examinations or grand jury proceedings using audiovisual technology. It removes the option to rely solely on ‘good cause’ to allow this testimony, requiring the State to provide a sworn declaration and a notice to the defendant and court within 48 hours. The notice must explain why the witness needs to testify via technology, citing residency more than 100 miles away or a medical condition. The amendments apply to offenses starting on or after October 1, 2025.
