Bill overview
This bill modifies South Dakota law to allow counties and municipalities with comprehensive plans to adopt their own ordinances and requirements governing sand, gravel, and aggregate mining operations. These local ordinances must align with state laws and rules, but cannot impose additional bonding or surety requirements already mandated by state law. The state Board of Minerals and Environment will consider local permits when issuing mining permits, and mining cannot begin until the applicant notifies the board that all necessary local permits have been obtained.
