This bill, known as ‘Cassie’s Law,’ creates a process for involuntary substance abuse intervention in West Virginia. It allows a spouse, parent, near relative, friend, or legal guardian to petition a court for treatment for an individual exhibiting signs of substance abuse impairment that poses a danger to themselves or others. The court will review the application, order an examination by a qualified professional, and, if probable cause is found, order up to 60 or 360 days of involuntary treatment, with failure to comply potentially leading to contempt of court charges.
