Overview
This bill establishes a process for the judicial appointment of a receiver to manage a closed or threatened-to-close hospital in New Jersey. If a hospital closes without obtaining a certificate of need or is facing closure without applying for one, the Department of Health, the Attorney General, or the local municipality can sue to appoint a receiver. The receiver can then take control of the hospital’s operations, maintain services, and pursue a certificate of need, with safeguards to prevent conflicts of interest.
