Bill overview
The Inventor Rights Act aims to strengthen patent protections for inventors and their companies. It prohibits the U.S. Patent and Trademark Office from reexamining inventor-owned patents without consent, establishes specific venue rules for patent lawsuits based on where research or development occurred or where a relevant facility is located, and creates presumptions for obtaining injunctions against patent infringement. The bill also allows patent holders to recover infringer’s profits and, in cases of willful infringement, triple damages, along with the ability to recover legal fees exceeding 10% of the damages awarded.
