The PURPA Modernization Act of 2019 aims to update the Public Utility Regulatory Policies Act of 1978 (PURPA) to clarify how facilities are determined to be located together for energy purchase purposes. It introduces a rebuttable presumption that facilities more than one mile apart are not considered to be at the same site, allowing for more flexibility in determining power production capacity. The bill also expands the criteria used to assess whether facilities are considered part of the same project and includes provisions to improve nondiscriminatory access to transmission and wholesale markets for qualifying small power production facilities.
