Bill overview
The FISA Oversight Correction Act modifies the Foreign Intelligence Surveillance Act (FISA) to clarify the circumstances under which a court can disclose information about surveillance activities to the individuals involved. Currently, disclosure is limited to what’s ‘necessary’ for determining legality. This bill expands the court’s ability to disclose information if it’s ‘likely’ to improve the accuracy of that legal determination. It specifically addresses disclosures related to foreign intelligence surveillance, physical searches, and the use of pen register and trap and trace devices.
