The American Indian Land Empowerment Act of 2020 allows federally recognized Indian tribes to designate certain land they own as ‘restricted fee tribal land.’ This means the land would be owned by the tribe or a tribal member but subject to restrictions preventing sale or taxation, similar to how trust land is managed. If a tribe requests the transfer of land to this status, the Secretary of the Interior must either convey the land or designate it as restricted fee within 90 days, and the tribe can later restore the land to trust status. The bill also addresses leasing and land management rules for these designated lands.
