This bill, the Keeping Guns From Criminals Act, changes the legal responsibility for selling firearms to prohibited individuals. Currently, sellers could avoid criminal charges if they didn't know the buyer was prohibited. This bill removes that ‘knowing’ requirement, making it a crime for anyone to sell a firearm to a prohibited person, regardless of their knowledge. However, sellers can offer an affirmative defense if they can prove the buyer passed a background check or had a valid concealed carry permit, unless they knew the buyer was prohibited.
