This bill, the Protecting Access to Innovation During COVID-19 Act, allows the Centers for Medicare & Medicaid Services (CMS) to extend the time that hospitals can receive extra payments (pass-through status) for certain drugs and devices. This extension is possible if the cost of these items cannot be accurately determined due to the impact of COVID-19. The bill applies to drugs and devices that already received pass-through status during the public health emergency, even if that status has already expired.
