The Farm Labor Expansion Act of 2020 (FLEX Act) provides a tax credit to farmers who hire unemployed workers. This credit is 40% of the eligible replacement worker's first-year wages, up to a maximum of $25,000 per worker over their career. The credit is available to workers who became unemployed after March 27, 2020, and were receiving unemployment compensation, and who perform similar work to H-2A workers. The credit is limited to the average number of H-2A workers employed by the farmer in the previous year and expires two years after the law’s enactment.
