Bill overview
The American Family and Private Property Defense Act expands legal defenses available to individuals facing charges of violence. It allows defendants to claim self-defense or defense of others if they reasonably believed their actions were necessary to protect themselves or a third party from unlawful force. The bill also establishes a defense for using physical force to prevent theft or property damage, and includes provisions regarding a ‘battered spouse defense,’ allowing evidence of such syndrome to be considered in self-defense cases. Importantly, it clarifies that individuals have no duty to retreat from their property or a location they have a right to be.
