Bill overview
This bill modifies the Biologics Price Competition and Innovation Act of 2009 to ensure that certain biological product applications, filed before March 2019 and pending as of March 2020, continue to be reviewed by the FDA. It also establishes a process for treating drugs that are biological products and previously identified as ‘listed drugs’ to maintain their status and subject them to relevant licensing requirements. Furthermore, the bill specifically addresses insulin products deemed interchangeable biosimilars, designating them as licensed under section 351 of the Public Health Service Act.
