The New Way Forward Act aims to reform U.S. immigration enforcement by significantly reducing the use of private detention facilities and changing procedures for arresting and detaining immigrants. It mandates that the Department of Homeland Security own and operate detention facilities, requires a 48-hour initial custody determination with a presumption of release, and limits the circumstances under which immigrants can be detained. The bill also restricts state and local law enforcement’s ability to assist with immigration enforcement, removes certain criminal grounds for inadmissibility, and establishes a 60-day removal period for those ordered to be removed. Finally, it repeals provisions related to mandatory detention and criminal penalties for immigration violations.
