This bill, the Protecting Benefits for Disabled Veterans Act of 2019, allows the Department of Veterans Affairs (VA) to assign a total disability rating to a veteran if they are unable to work due to a service-connected disability. Specifically, a veteran with a disability rated at least 60% or two or more disabilities totaling at least 70% is eligible. The VA can also make this determination if a veteran with gainful employment is deemed to benefit from a total disability rating, considering their overall financial situation. The bill also clarifies which disabilities are considered as a single disability and prohibits the VA from considering a veteran’s age or retirement eligibility when making these determinations.
