Bill overview
The STABLE Act allows employers to contribute to their employees’ ABLE (Achieving a Better Life Experience) accounts, which are designed for individuals with disabilities. These employer contributions are treated as medical expense coverage under an employee’s health plan, excluding them from the employee’s taxable income. The bill also establishes a tax penalty for employers who fail to make these contributions and adjusts tax codes to account for these contributions, specifically regarding railroad retirement tax, unemployment tax, withholding tax, and W-2 reporting.
