This bill, the Closing Loopholes for Orphan Drugs Act, changes how the 340B drug discount program works. Currently, drug manufacturers offering discounts through the 340B program are required to exclude ‘orphan drugs’ – medications for rare diseases – from those discounts for certain healthcare facilities. This bill removes that restriction, allowing manufacturers to discount orphan drugs for all entities participating in the 340B program, regardless of whether they are being used to treat a rare condition.
