The New Economy Works to Guarantee Independence and Growth Act of 2019, or the NEW GIG Act, aims to clarify how online workers are classified for tax purposes. It introduces a ‘safe harbor’ test to determine if a service provider should be considered an independent contractor rather than an employee. If the test’s requirements are met, the service provider, recipient, and payor are not treated as employer-employee relationships, and compensation isn't classified as employment income. The bill also establishes reporting requirements for service recipients and allows service providers to petition the Tax Court for a determination of their employment status, and makes adjustments to reporting requirements for third party payment networks.
