The Biologic Patent Transparency Act aims to increase transparency around patents related to biologic drugs. It requires companies holding licenses to market these drugs to disclose all patents they believe could be infringed upon by others producing or selling the drug. The Department of Health and Human Services (HHS) will then publish a publicly accessible list detailing these patents, along with information about the drug itself, such as its name, exclusivity periods, and interchangeability status. Furthermore, it prevents patent holders from suing for infringement if they failed to disclose relevant patents to HHS.
