The Disarm Hate Act amends federal law to prevent individuals convicted of a misdemeanor hate crime or sentenced to an enhanced misdemeanor hate crime from possessing firearms. Specifically, it expands the definition of ‘convicted’ to include cases where a person knowingly and intelligently waived their right to counsel, and clarifies the criteria for determining when a sentence is considered an ‘enhanced’ hate crime misdemeanor. The bill also restricts the sale and transfer of firearms to individuals meeting these criteria, and prohibits their shipment, transport, and possession.
