This bill, the Early Participation in Regulations Act of 2019, requires federal agencies to give the public advance notice before proposing major rules. Specifically, agencies must publish an ‘advance notice’ at least 90 days before a proposed rulemaking if the rule is likely to have a significant economic or other impact. The advance notice must detail the problem the rule aims to address, potential regulatory options, and allow for public feedback for at least 60 days. However, certain exceptions exist where providing advance notice would not serve the public interest or be unduly burdensome.
