This bill, the Flood Reduction, Wildlife Habitat, and Water Quality Improvement Act of 2019, modifies regulations for permits used to discharge dredged or fill material into U.S. waters. It limits the Environmental Protection Agency’s (EPA) ability to prevent the designation of areas as disposal sites, particularly when those areas are involved in flood control projects. The bill also establishes requirements for the EPA to consult with the Army Corps of Engineers and review environmental impact statements before making decisions about such areas. Finally, it allows for the immediate withdrawal of prior EPA determinations regarding flood control projects if a more practical alternative hasn’t been identified and severe flooding has occurred due to delays.
