Bill overview
The Veterans’ Second Amendment Rights Restoration Act of 2019 aims to protect the firearm rights of veterans. It changes how the Department of Veterans Affairs (VA) determines if a veteran is considered a danger to themselves or others for the purpose of denying firearm ownership. The bill requires the VA to prove, by clear and convincing evidence, that a veteran poses a danger before they can be deemed mentally incompetent, and it establishes a process for administrative and judicial review to challenge this determination. It also addresses existing records in the National Instant Criminal Background Check System.
