Bill overview
The Fair FSAs Act of 2020 requires employers to allow employees to receive a cash distribution from their health flexible spending arrangements (FSAs) when they leave their jobs. It also allows employees to roll over unused FSA funds from 2020, if those funds were due to reduced expected healthcare expenses because of the COVID-19 pandemic. The bill includes a penalty for employers who fail to provide these distributions and extends the timeframe for FSA claims related to 2020.
