This bill, the Burial Equity for Guards and Reserves Act of 2021, ensures that the Department of Veterans Affairs (VA) cannot restrict state-owned veterans’ cemeteries from burying members of the National Guard, Reserve components, and their families, even if those individuals aren’t eligible for burial in national cemeteries. Specifically, the VA is prohibited from denying grant applications or imposing conditions on grants based on this restriction. The bill also provides for plot allowances for these individuals and prevents the VA from enforcing conditions on existing cemetery grants established before the bill’s enactment.
