The SERVE Act of 2021 modifies how nominations are made to the military and maritime academies when a member of Congress (Senator or Representative) dies, resigns, or is expelled from office, and their successor hasn’t yet been sworn in. If a Senator doesn't submit a nomination, the other Senator from that state must make it, and if a Representative doesn't, the Senators from the Representative's district must make the nomination, with any remaining nominations going to the senior Senator. This ensures that academy nominations continue to be made even during vacancies in Congress.
