The Protect Americans from Foreign Criminals Act of 2021 requires the Department of Homeland Security (DHS) to conduct thorough criminal background checks on individuals unlawfully present in the United States before releasing them from custody. These checks must include databases from the U.S., the individual’s country of origin, and any countries they passed through. If a background check reveals a conviction for an aggravated felony, membership in a criminal street gang, or other concerning factors, DHS cannot release the individual pending removal proceedings. The bill also mandates a review of international criminal history databases to ensure they meet U.S. standards and prevents the release of individuals if those databases are inadequate.
