The Essential Caregivers Act of 2021 requires skilled nursing facilities, nursing facilities, intermediate care facilities for the intellectually disabled, and inpatient rehabilitation facilities to allow residents to designate up to two essential caregivers during public health emergencies. These caregivers can provide daily assistance, emotional support, or companionship, with facilities required to grant them access for at least 12 hours daily, or unlimited hours for end-of-life care, provided they adhere to facility protocols. The bill also establishes a process for residents and caregivers to appeal decisions denying access and outlines enforcement mechanisms for facilities that violate the requirements.
