The Fair and Open Competition Act (FOCA Act) aims to ensure fair competition and neutrality in federal construction projects. It prohibits federal agencies from requiring or prohibiting project labor agreements (PLAs) in bid specifications or other controlling documents, and prevents discrimination based on a contractor’s decision to sign or not sign a PLA. The bill also establishes a process for agencies to exempt projects from these restrictions in cases of imminent threats to public safety or national security, and mandates revisions to the Federal Acquisition Regulation to implement these changes.
