The Therapeutic Fraud Prevention Act of 2021 prohibits commercial conversion therapy, which is defined as any practice that attempts to change a person’s sexual orientation or gender identity for profit. The bill finds that such practices are ineffective and harmful to individuals’ mental and physical health. It empowers the Federal Trade Commission and state attorneys general to enforce this prohibition and prevent deceptive advertising related to these practices. The bill also clarifies that treatments assisting gender transitions or providing support for identity exploration are not considered conversion therapy.
