The Holocaust Insurance Accountability Act of 2021 aims to allow Holocaust-era insurance policyholders and their heirs to sue U.S. insurers for unpaid claims. The bill creates a new federal private right of action, allowing lawsuits in U.S. district courts to recover policy proceeds and related damages, including prejudgment interest and treble damages for bad faith. It also establishes a 10-year statute of limitations for these claims and clarifies that prior agreements with the International Commission on Holocaust Era Insurance Claims won’t bar new lawsuits, while also preventing executive agreements or foreign policies from preempting state laws or claims.
