The Cyber Response and Recovery Act of 2021 authorizes the Department of Homeland Security (DHS) to declare a ‘significant incident’ – a cyber event that causes serious harm to national security, public confidence, or public safety – and establishes a dedicated fund to support the response. If existing resources are insufficient, DHS can declare an incident and coordinate federal and local efforts to mitigate the impact. The fund will provide financial assistance for various response activities, such as technical support and hardware replacement, and requires the Secretary to report on the declaration’s impact and use of funds.
