Bill overview
The Fourth Amendment Is Not For Sale Act aims to protect Americans' privacy by limiting how law enforcement and intelligence agencies can access and use personal data. It expands restrictions on the disclosure of stored electronic communications to include intermediary service providers, often called data brokers. The bill also prohibits law enforcement from purchasing records from third parties and establishes stricter requirements for obtaining customer and subscriber records, including court orders. Furthermore, it reinforces the exclusive authority of the Foreign Intelligence Surveillance Act for acquiring certain types of information related to foreign intelligence purposes.
