The FinCEN Accountability Act of 2023 aims to increase transparency and oversight of the Financial Crimes Enforcement Network (FinCEN). It requires the Treasury Department to disclose all ‘controlling documents’ – records that direct or delegate authority to FinCEN – to Congress and the public, with limited exceptions. Furthermore, the bill restricts the Treasury Secretary’s ability to make exceptions to FinCEN rules, and extends the term for which FinCEN is considered a ‘covered agency’ for regulatory flexibility purposes.
