The HSA Modernization Act of 2023 aims to update and expand the rules surrounding Health Savings Accounts (HSAs). It allows individuals without service-connected disabilities and those eligible for certain veteran benefits to contribute to HSAs, expands eligibility to include those receiving Medicare Part A benefits, and addresses coverage for individuals receiving Indian Health Service assistance. The bill also includes provisions to clarify HSA rules for bronze and catastrophic plans, establishes a safe harbor for mental health services, adjusts contribution limits, and clarifies the treatment of distributions for long-term care services. These changes are effective starting December 31, 2025.
