The Unfunded Mandates Accountability and Transparency Act of 2023 aims to increase transparency and accountability in federal rulemaking. It requires federal agencies to conduct detailed regulatory impact analyses for ‘major rules’ – those likely to have a significant economic effect – and to publish these analyses in the Federal Register. The bill also strengthens stakeholder consultation, mandates that agencies select the regulatory alternative that maximizes net benefits, and provides new authorities for the Office of Information and Regulatory Affairs to oversee agency compliance with these requirements. Finally, it includes provisions to ensure that agencies consider the cumulative impact of regulations and exempts monetary policy rules from certain requirements.
